2. Website use

You may use this website for lawful purposes and in a way that does not infringe another person’s rights, damage the site, introduce malicious code, attempt unauthorised access, scrape restricted content, or interfere with its availability. You must not use information on this website as a substitute for professional legal, financial, technical or other advice.

We may update, suspend or withdraw any part of the website without notice where reasonably necessary for maintenance, security, business or legal reasons. We do not guarantee that the site will always be available, error-free or compatible with every device.

3. Information on the website

We aim to keep descriptions, examples and other content accurate and current, but portfolio material may be illustrative or conceptual. Nothing on the website is an offer capable of acceptance, a price quotation, a guarantee of results, or a promise that a particular service is available. A binding engagement arises only through a written proposal, statement of work or services agreement accepted by both parties.

4. Proposals and project agreements

Each project should be governed by a written agreement that states the scope, deliverables, milestones, responsibilities, fees, expenses, review rounds, approvals, intellectual property position and termination terms. If a project agreement conflicts with these website terms, the project agreement controls for that project.

We may rely on information and materials supplied by you. You are responsible for ensuring that your brief is accurate, that feedback and approvals are timely, and that you have the rights needed for materials you provide.

5. Fees, invoices and expenses

Fees, payment dates, taxes and reimbursable expenses will be set out in the applicable proposal or agreement. Unless otherwise stated, invoices are payable within the period specified on the invoice. We may pause work or withhold delivery where undisputed invoices are overdue, after giving reasonable notice. You remain responsible for third-party costs approved or requested by you.

6. Client responsibilities and approvals

You must provide accurate content, access, assets and decisions needed for the project. You must review deliverables within the agreed time and promptly identify material errors. Delays caused by missing information, late feedback or changed requirements may affect timing and fees.

Approval of a deliverable confirms that it meets the agreed brief, subject to any express warranty in the project agreement. Additional work or a materially changed brief may require a written change order.

7. Intellectual property

7.1 Our materials

Our pre-existing methods, templates, design systems, know-how, concepts not selected, reusable components and tools remain ours. We grant you only the rights expressly stated in the relevant project agreement.

7.2 Client materials

You retain ownership of materials you supply. You grant us a limited licence to use them as necessary to perform the agreed services. You warrant that this use will not infringe another person’s rights.

7.3 Final deliverables

Ownership or licence rights in final deliverables transfer only as specified in the applicable project agreement and, where relevant, after payment of all due fees. Third-party fonts, stock assets, software, open-source components and other licensed materials remain subject to their own terms.

7.4 Portfolio use

Unless the project agreement says otherwise, we may identify the client and display publicly released final work in our portfolio and professional communications. We will not knowingly disclose confidential information, and you may ask us to delay publication until an agreed launch date.

8. Confidentiality

Each party must protect non-public information received from the other and use it only for the relevant project. This obligation does not apply to information that is public without breach, already lawfully known, independently developed, lawfully received from another source, or required to be disclosed by law.

9. Privacy and data protection

Personal data will be handled as described in our Privacy Policy. Where we process personal data on your documented instructions as a processor, the parties will put in place any data processing terms required by applicable law, including the subject matter, duration, purpose, data types, data-subject categories, security measures, sub-processors and assistance obligations.

10. Third-party services and links

Websites and projects may depend on hosting, domain, font, software, payment, email or other third-party services. Those services may have separate terms, fees, availability and privacy practices. Unless expressly agreed, we are not responsible for a third party’s acts, omissions, content, security or continued availability.

11. Warranties and corrections

We will perform agreed services with reasonable care and skill. If a deliverable materially fails to meet an express requirement in the project agreement, your first remedy is to notify us and allow a reasonable opportunity to correct it. Except where the law does not permit exclusion, all other warranties are excluded to the fullest extent allowed.

12. Liability

Nothing in these terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory rights that cannot be waived.

Subject to that protection, neither party is liable for indirect or consequential loss, loss of profit, revenue, anticipated savings, goodwill or opportunity. Any overall liability cap will be stated in the applicable project agreement. If no cap is agreed, liability is limited to the fees paid or payable for the relevant project, except where a different limit is required by law.

13. Suspension and termination

A project may be suspended or terminated in accordance with its project agreement. We may suspend access to the website or services where necessary to address security, legal or payment issues. On termination, each party must return or securely delete confidential information where reasonably requested, subject to legal retention requirements and backups.

14. Changes to these terms

We may update these website terms by publishing a revised version. The updated version applies to future use of the website from the stated effective date. Changes to an agreed project require written agreement under the project’s change-control process.

15. Governing law and jurisdiction

These terms and any non-contractual dispute arising from them are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights available to consumers or any different jurisdiction required by applicable law.

16. General

If a provision is found invalid or unenforceable, it will be adjusted or removed only to the extent necessary and the remaining provisions will continue. A failure to enforce a right is not a waiver. These terms do not create a partnership, agency or employment relationship between the parties.
